Welcome to Parliamo Accademia di Italiano («we» or «the Academy»). These Terms and Conditions explain how you can make use of our services. By accessing the website www.parliamoaccademia.com, you are confirming having read, understood and accepted these terms, as well as our Privacy Policy, independently whether you are registered as a user or not. This agreement applies to all visitors of the website («student», «you», «user»).
We can modify these terms at any time and at our entire discretion. The latest actualization date is stated at the end of the document. It’s your responsibility to review the terms periodically. The continuous use of the website or our services after any alteration implies its acceptance.
The services are destined exclusively for the personal use of the students. It’s not allowed to share the course material nor use it to impart classes. The improper use of the course contents can lead to legal sanctions due to infraction of copyrights.
Parliamo Accademia doesn’t provide the equipment nor the connection necessary to access the service. You are responsible of any costs associated, such as charges related to the internet provider or other third parties involved.
2.1. Age requirement
To use our services, the user must be at least 18 years old and have accepted the terms on their own behalf. If under the age of 18, a father, mother or legal guardian will have to register and accept the terms on their behalf.
According to the Law 1581 of 2012 about Data Protection and its actualizations, 13-year-old minors should not provide personal information through our services, nor participate in promotions, contests or giveaways related to the Academy. Besides, they should be accompanied by an adult while they are making use of the platform.
In case a minor wishes to participate in advertising or promotional content of the Academy, local laws about minors’ protection should be strictly respected. Any contrary disposition will be considered null, given that children’s privacy rights are non-waivable. All conditions must adjust to the current legislation and the integrity of the parties involved.
3.1. Platform
Parliamo Accademia di Italiano is a virtual learning center that offers Italian courses through a virtual platform. Through this, the students access livestream classes and pedagogical material with the accompaniment of qualified professors.
3.2. Registration
When registering to the platform, you commit to provide truthful information, updated and complete, just as solicited in the registration form. The handling of your data is regulated by our Privacy Policy.
3.3. Account, password and security
You are responsible for maintaining your passwords confidentiality and all activities made in your account. You should notify us immediately about any non-authorized movements. When finishing every session, it is recommended to close session. We are not responsible for any losses derived from the misuse of the account.
3.4. Teachers
Classes are given by external teachers, that can or not be related directly to the Academy. Even though we verify their profiles, we do not take responsibility for the veracity of the information nor we assume responsibility for mistakes, omissions, or advice given. We guarantee that, through every course of 12 weeks, at least the 50% of the classes will be dictated by a native Italian.
3.5. Livestream classes
We offer live virtual classes as optional complement to the pedagogical material. Assistance isn’t mandatory nor a condition to complete the course, since the programs can be completed using the virtual pedagogical material in the platform. Therefore, it’s not mandatory either for the Academy to carry them out. We can establish participation conditions, such as previous enrollment within set timeframes, to organize groups, schedules and teachers. We don’t guarantee access to classes to the students who don’t fulfill these conditions. Only registered students or the authorized personal can access the livestream classes. Sharing the access links is strictly prohibited.
3.5.1. Cycle durations
The livestream class cycles have a planned duration of 12 weeks. We can modify this duration and the start date at our own discretion. Those who have enrolled before the modification, will be able to accept the new dates or wait for the new cycle. Refunds are not made for these changes, because livestream classes are not essential to complete the course and the students have accepted that they can complete the course with the virtual pedagogical material.
3.5.2. Schedules
The schedules in which the livestream classes will be dictated are the same ones as published in the website or communicated by our official canals. We can modify days and schedules without previous notice.
3.5.3. Length of livestream classes
Depending on the class type, this can last in between a range of 60 and 90 minutes. This means that some classes can last more and others can last less. We guarantee that the average duration of all course’s classes is equal or superior to the commercially announced time.
3.5.4. Number of participants
On the livestream classes, teachers, students, and personal authorized by the Academy such as observers and other personal that fulfill a specific function in our operations can participate. You accept that we define the maximum number of participants in each and every one of our livestream classes and that the numbers communicated commercially correspond to approximated values. Therefore, the real number of participants can be superior or inferior to said reference.
3.6. Expiration, repetition and freezing
If the student can’t attend the livestream classes, they should rely on the virtual pedagogical material available in the platform to complete the course. It’s possible to request the freezing of the course only during the first two weeks of classes. After this period, freezing solicitations won’t be accepted.
When enrolling to the next level course, the student has the option to freeze that course to repeat free of charge the current level. For example, if a student is coursing the Base Course and they enroll in the Intermediate Course, at the end of the current cycle they could choose between continuing with the Intermediate Course on the next cycle, or freeze the Intermediate Course and repeat free of charge the Base Course You may only retake the same course for free once. The frozen course can remain on hold for a maximum of one year from the date of enrollment. After that time, it will expire and re-enrollment will be required to take the course again. These conditions apply to all levels: Base Course, Intermediate Course, Advanced Course, and Tour Course.
Once the 12-week cycle of livestream classes has been completed, the student’s access to the virtual pedagogical material will be restricted. However, if the student enrolls to the next level, they will be able to conserve access to the completed course material for an additional period of time, the duration of which will be determined exclusively by the Academy.
3.7. Tests and evaluations
We can use evaluations that condition access to certain contents, with the goal of fomenting study and guaranteeing real progress in the learning of the language.
3.7.1. Certificates
Parliamo Accademia issues certificates that prove the fulfillment of the learning objectives defined in our curriculum. The validity or acceptance of these certificates will depend exclusively on the entity that requires them.
Our courses are designed to prepare the students for International Certification Exams, such as the CILS and the PLIDA. However, Parliamo Accademia does not organize, manage nor offers directly these certifications. All costs and paperwork related to their presentation are responsibility of the student.
We can occasionally publish information related to the International Certificate Exams, but it’s the student’s responsibility to verify directly with the responsible entities. Parliamo Accademia does not take responsibility for problems related with the inscription or presentation of these exams. By agreeing to these terms, the student expressly resigns to any reclaim against the Academy for these reasons
As an incentive to present the International Certification Exams, we can offer a partial refund of the cost of the exam, as long as it doesn’t exceed 120 euros. To access this benefit, the student must obtain the certificate, send us a payment receipt for the exam and make a video following the instructions that the Academy will provide. This video may be used for commercial purposes, without generating any additional compensation.
Parliamo Accademia di Italiano offers promotions periodically through bonuses or coupons for which the student must prove, using a code or reference number, that they are valid for redemption.
Parliamo Accademia di Italiano can, sometimes, place advertisements or present offers and promotional materials on or through the Service. Your participation in any promotion or offer is subject to the applicable rules related to the promotion. Your relationships with other entities or third parties, as well as your participation in promotions or offers from third parties that are advertised or appear on the Service, are solely between you and the third party. Please note that you must be at least 18 years old to participate in any promotion or offer that is connected or in any way related to the Service. You agree that we will not be responsible for any damage or loss arising from such relationships or the presence of such advertisers on the Service.
The policies, terms, and conditions of each promotion, which will define the prices, duration, payment methods, the individuals who can benefit from it, the products that can be purchased, and other information regarding the promotion, will be notified on the Service or through any of its channels once the relevant promotion information is published.
The website and our material cannot be used by any person or organization to recruit, solicit, or contact students or teachers for employment or to hire a business not affiliated with Parliamo Accademia di Italiano. You may not copy the content of our website, including, among others, any of the records or profiles of our users or teachers, and you are prohibited from using any technology, method, or scheme to track, reproduce, cache, or duplicate all or any part of the content on our website.
You may not use any other technology or automated code of any kind to copy, reproduce, or download content from our website. If we discover that you have violated the terms of this paragraph or any other terms outlined in here, we reserve the right, at our discretion, to immediately suspend your use of the website and our services, as well as initiate legal action against you.
It is a violation of these terms to use any information obtained from the website to harass, abuse, or harm another person, or to advertise, solicit, or sell our service without prior explicit consent. To protect our users from such activity, we reserve the right to take appropriate action, including blocking access to the website and services, with or without prior notice.
You agree not to display, distribute, license, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, transfer, or transmit the content for any commercial purpose. The service is for your personal use only and may not be used for commercial purposes that are not authorized by us.
6.1. Means and payment methods
If you decide to enroll in any of our courses, you may use the methods and means of payment offered on our platform, that is, by means of PSE, PayPal, bank transfers, or credit card.
6.2. Bank transfers and with credit card
During the registration process, you will be asked to provide information about your credit card or bank account (your “payment instrument”). As a user of the Service, you agree to allow charges to your credit card or debits to your bank account for the applicable fees, as well as any sales tax and other charges incurred in connection with your use of the Service. Except as stated in this document, no fee or charge is refundable.
In the case that you use your credit card to make purchases on the Service, we may, at our discretion, charge your credit card individually for each transaction or combine your charges with other purchases made on the Service. In this regard, you agree to pay all amounts incurred under the Purchase Terms and to maintain sufficient funds in your payment instrument to cover any amounts owed to the Company. Additionally, you are responsible for maintaining the confidentiality of your Parliamo Accademia di Italiano account and will be held responsible for any charges incurred by another person through your account.
All charges will be billed to the payment instrument that you designate when you make your first purchase or incur a charge on the Service. Any bank fee or charge applied to your payment instrument by your financial or credit institution will be your responsibility. If your billing information changes, you must update it by contacting a Company advisor or representative by calling the number listed on the website www.parliamoaccademia.com, or via the learning platform using the “Contact Us” link. By providing your credit card, bank account, or other payment information to the Company, you acknowledge and agree that we may store your payment instrument information until your Parliamo Accademia di Italiano account is closed, and, as stated in the Privacy Policy, unless you request to Parliamo Accademia di Italiano Customer Support to delete your credit card and/or bank account information, in which case it will be deleted as outlined in the Privacy Policy.
By providing your payment instrument information to the Company, you agree to review the terms and conditions imposed by the issuer of your payment instrument regarding notification requirements and limitations of liability that apply in the event of loss, theft, or unauthorized use of your payment instrument. You agree that you, and not Parliamo Accademia di Italiano or its Affiliates, will be the solely responsible for paying all amounts billed to your credit card by unauthorized third parties. You also agree not to provide information about any payment instrument that has not been issued in your name
6.3. Taxes
Purchases made through the Service may include IVA, and this tax will be based on the best available information regarding your address. In such cases, the tax rate in effect at the time of purchase will be applied. If the rate changes before the purchase is completed, the new rate in effect at the time the purchase is finalized on the Service will apply. Other limitations and disclaimers regarding products and services may also apply. You will be solely responsible for paying all such taxes.
6.4. Right to change prices
All prices related to the Service are subject to change by Parliamo Accademia di Italiano at any time, without prior notice and without any responsibility towards you. The Academy does not offer price protection or refunds in case of a price drop or promotional offer, the validity period of which will be determined exclusively by Parliamo Accademia di Italiano and may be shortened or extended at our sole discretion, with or without prior notice.

8.1. Copyright
All information and other content uploaded to the platform is the property of Parliamo Accademia di Italiano, and any improper or unauthorized use of the Academy’s content will be penalized as provided by law. Use for profit by third parties without express authorization from Parliamo Accademia di Italiano violates intellectual property laws and will result in legal sanctions.
8.2. Trademarks
The user may not use the Parliamo Accademia di Italiano trademark for any other purpose, under penalty of legal consequences as provided by law.
8.3. Action for Violation of Intellectual Property Rights
If Parliamo Accademia di Italiano receives a notice alleging that you have engaged in conduct that violates any intellectual property rights of the Company, its Affiliates, or a third party, or reasonably suspects such conduct, the Company may suspend or terminate your access to the Service without notice. If the Company takes action in accordance with this Section, it will have no liability to you, including for any amounts previously paid or any credits you may have on the Service.
9.1. Disputes between users
You agree that you are the solely responsible for your interactions with any other user through our services, and that we will have no liability or obligation with respect to them. We reserve the right to get involved in disputes between you and any other user, but we are not obligated to do so.
9.2. Modifications to the Service
Parliamo Accademia di Italiano reserves the right to modify or discontinue the service (or any part of it) temporarily or permanently, with or without prior notice. You agree that we will not be liable for any inconvenience this may cause you or any third party.
9.3. General Practices Regarding Use and Storage
You acknowledge that Parliamo Accademia di Italiano may establish limits on the use of the service, including among others, the maximum period of time the service will retain data or other content. You agree that we are not responsible for the deletion or failure to store data or other content maintained or transmitted by the service. You acknowledge that we reserve the right to cancel accounts that are inactive for an extended period of time. Furthermore, you acknowledge that we reserve the right to change these general practices and limits at any time, at our sole discretion, with or without prior notice.
9.4. Access to data in the Service
The Academy may access and review class recordings, messages, chat transcriptions, or other private class information to provide better service to the student, review abuse claims, and for other reasons consistent with our Privacy Policy.
9.5. Data Processing Policy
Parliamo Accademia di Italiano, in strict compliance with its legal obligations and committed to the proper handling of the information you have provided, addresses legal requirements established by the Law 1581 of 2012 and the Decree 1377 of 2013 regarding the management of databases and information about third parties.
According on the above, by voluntarily providing your contact data to receive information or registering for the Academy’s services via any of our virtual platforms, you authorize us to process your personal data, that is, to perform operations such as collection, storage, use, circulation, transfer, or transmission. You also allow its processing by our representatives or those with whom we enter into data transfer or transmission agreements, such as intermediaries and data handlers, both within and outside the national territory.
Likewise, you also authorize us to process photographic, videographic, or audiovisual material in which you may appear so that Parliamo Accademia di Italiano may use it as it deems appropriate according to its corporate purposes. The student declares that they understand the purposes for which their personal data or the data of the person they represent will be processed, including receiving quotes, offers, and promotions for our products or services as indicated at the time of this authorization and thereafter. We will also use your data to request you to participate in surveys for commercial or advertising purposes through calls, WhatsApp messages, text messages, emails, SMS, among others.
The student also authorizes the processing of sensitive data, particularly, health-related and biometric data, understanding that the questions about these data or those of the minors they represent are optional. As the holder of personal data, you understand your rights under the law, particularly the right to know, update, rectify, and request the deletion of your data. You declare that the data you have provided to the Academy is accurate, and you authorize its verification with any public or private person or entity. This authorization remains valid as long as the purposes for which your data will be processed persist and for an indefinite period.
9.6. Links to Third-Party Websites; RSS News
Parliamo Accademia di Italiano is not responsible for the content or availability of news in RSS format or third-party websites related to the Service, nor is it responsible for third-party websites that link to or from the Service. Your access to RSS news and links to other websites is entirely at your own risk. All RSS news and links are provided for your convenience only and should not be interpreted as an endorsement of the site owner/sponsor. 9.7. Content exposed by the user
You are solely responsible for all information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials («content») that you upload, post, and/or display, whether by email or any other method of transmission through our platform. You agree not to post content that is illegal, threatening, abusive, harassing, defamatory, libelous, misleading, fraudulent, invasive of another person’s privacy, tortuous.
You also agree not to post content with explicit or graphic descriptions or depictions of sexual acts (including, among others, sexually violent or threatening language directed at an individual or group). Impersonating any person or entity, including any of our employees or representatives, is a serious offense that may lead to legal problems and penalties as determined by the Academy and the law.
We do not endorse or take responsibility for user-posted content. In general, we do not pre-select, monitor, or edit user-posted content. We have the right, at our sole discretion, to remove any user-posted content or other content that we deem harmful, objectionable, or inaccurate. We are not responsible for any failure or delay in removing user-posted content. You agree to such removal and waive any claims against us arising from the removal of any content posted by you or another user.
You may not use your account to violate the security of another account or attempt to gain unauthorized access to another network or server. Not all parts of our platform may be available to you or other users. You will not interfere with the use of the service by another person. Users who violate the network or system security may incur criminal or civil liability.
You agree that we may, at any time and at our sole discretion, terminate your membership, account, or other affiliation with the service without prior notice for violating any of the above provisions. The amount of PII you provide is entirely up to you. A minimum amount of PII is required to complete registration on the website. The PII provided by teachers through the platform may be available to visitors, future students, or affiliates. We may share your PII with third parties for promotional purposes.
You may also provide non-personally identifiable information to the Academy, such as interests, background, age, etc. Although this information is optional, we may use it to improve your experience by showing you content we believe might interest you and displaying content based on your preferences. 9.9 Applicable legislation
Any dispute or claim arising out of or relating to these terms and conditions, other than claims for damages, violation of industrial property rights, violation of industrial secrecy, grounds for termination, will be handled before the Conciliation Center of the Cali Chamber of Commerce. If conciliation fails, it will proceed before the relevant judicial authorities according to Colombian law.
9.9.1. Damages and prejudices
Some jurisdictions don’t allow the exclusion or limitation of implied warranties or liability for incidental or consequential damages, so such exclusions or limitations may not apply to your case. To the extent that, in a particular circumstance, any legal notice or limitation on damages or liability set forth here is prohibited by applicable law, then, instead of the provisions of this agreement in that particular circumstance, the Academy will have the right to the maximum waivers and/or limitations on damages and liability available under law and equity under such applicable law in that specific circumstance. In no case will such damages or the total liability of the company exceed the amounts you have paid in the last 9 months or $400,000 COP, whichever is greater.
